Please read these Terms and Conditions (“Terms”) carefully before agreeing.
In these Terms and Conditions, unless otherwise stated, the following words and expressions have the following meaning:-
Privacy Policy
Before agreeing to these Terms and Conditions please read our Privacy Policy regarding our user data collection.
Payment Terms
A deposit is required in order to secure the booking, this deposit is to be paid at the time of booking and will secure the equipment hire for the date of your event. Bookings will not be confirmed until this deposit has been received. The remaining balance will be payable 4 weeks before the event, the equipment will not be sent until this payment has been received. Any additional extras requested will be added to the final balance and will be payable with the remaining balance.
A security deposit of £250 will be payable with the remaining balance, this will be refunded in full once The Equipment has been returned on time and with no significant damage.
The Hirer will be liable for full payment of all charges, late return charges (24-hours will be charged as one day at £50 per day) and charges for loss, damage or theft of The Equipment (if applicable).
Rental Period
The equipment will be delivered to the agreed address 2 days prior to the event and returned via Royal Mail the first working day after the event. The Hirer agrees that the equipment will be returned in the same packaging that the equipment was received in, with the pre-paid label provided. If there are any issues which results in the courier being unable to deliver or collect The Equipment on the agreed date, The Hirer will be liable for the costs of rebooking the delivery and if The Equipment is received by The Company late then the client will be charged late fees as detailed in Payment Terms.
If delivered to The Hirer the signature of any person at the agreed delivery address shall be sufficient evidence of delivery.
Conditions of use
The Company will provide The Hirer with The Equipment mentioned in the booking form
The Equipment remains at all times the property of The Company and The Hirer has no right to sell or offer for sale The Equipment, parts of the equipment, accessories or any other item supplied within the Agreement. The Hirer will not hire, rent or dispose of the equipment, parts of The Equipment or accessories to any third parties. The Hirer must not let anyone attempt to fix or alter The Equipment.

The Hirer’s Responsibility
On delivery of The Equipment to the agreed address, The Hirer becomes solely responsible for the equipment, until The Company has received The Equipment back and accepts full responsibility for loss or damage to The Equipment. The Hirer agrees to examine the camcorder(s) and accessories (if applicable) upon receipt. If there are any issues, The Hirer must contact The Company on 07428768005 immediately so any issues can be rectified as soon as possible. The Company will not be liable for any loss of footage, poor quality footage or damage or loss of equipment due to The Company not being notified immediately of any issues. The video produced by The Company is for The Hirer’s personal use and The Hirer is liable for any form of copyright infringements or any other claims and/or disputes arising from the making and/or the release of the video. Please ensure that you
read the ‘Top Tips’ and ‘Suggested Shots’ (sent following booking confirmation). It is The Hirer’s sole responsibility to ensure anyone using the camcorder(s) has read the 'Top Tips" provided and has a general understanding of how camcorders work. The Company will not be held liable for memory card failure due to the memory cards being removed from the camcorder.
The Hirer is responsible for any damage to The Equipment caused by misuse or negligence on their part.
The Company’s Responsibility
Should The Company be unable to perform the services agreed within the booking (except for those reasons stated above); all fees paid by The Hirer will be refunded in full. The Company will not be held responsible for services affected by delays beyond their control. Delays beyond our control include, but are not limited to: pandemic outbreak, acts of nature, electric power failure, strikes, labour disputes, insurrections, civil disturbances, fire, flood, storms, explosions, war, governmental action, non performances of third parties. The Company will not be liable for any compensation for delays outside of our control.
The Company will communicate with The Hirer by e-mail or by telephone, if The Hirer wishes to instruct The Company they must do so by e-mail at least 1 week before the date of the event. The Company will not be held responsible for any miscommunications due to The Hirer not providing written instructions.
Supplied Equipment
The Company agrees to hire (depending on package):
The supplied equipment must only be used to film The Hirer’s event as agreed on the Booking Form and the final video will be made available to view online. Once The Hirer has confirmed that they are happy with the video and any changes have been made (if applicable) The Company will send the final video on a USB stick to the address agreed in the Information Form. Please note that extra copies of the final video will be available to purchase at a cost of £15 per extra USB. The Company will not be held liable for any delays in delivery of the final video due to The Hirer not instructing The Company of approval or changes to the final video in a timely manner. The Company will notify The Hirer of any significant delays in getting the finished video delivered.
The Hirer can request one re-edit which must be requested by single email, so long as this is requested no later than two weeks after the online video has been made available. Please ensure that all music choices, names and locations are provided on the Information Form.
The Company will keep The Hirer’s unedited wedding footage and final video on file for 12 months from the date of the event. The Hirer can request all unedited footage on a USB stick up to 12 months from the date of the event at a cost of £50.
Loss, Damage & Theft
General wear and tear of The Equipment is expected but The Hirer will be charged the repair costs of any serious damage to the camera(s) or scratches to the lens. In the case of loss or theft of one or both of the cameras, The Hirer will be charged the full price of the camera(s) and equipment.
In the case of theft, the police will be contacted and full investigation undertaken.
Indemnity
The Hirer agrees to indemnify The Company from and against all claims arising in respect of any and all losses, damages, claims or liability of any kind whatsoever, including legal expenses arising from the use, condition (including, without limitation, latent or other defects) or operation of The Equipment, and by whosoever used or operated The Equipment during the rental term. The Company is not responsible for accident or injury caused directly or indirectly by the use of The Equipment. The Company will not be held responsible for the lack of footage, poor quality of footage and the loss of memory cards. All equipment should be kept in the carry cases when not in use.
The Company is not liable for any claims in respect of loss of footage or any consequential loss whatsoever or be under any liability for or in respect of loss or damage to persons directly or indirectly from the hire or use of equipment by The Hirer.
Refusal of Service
The Company reserve the right the refuse rental service to anyone at anytime where we deem it is in our best interest. The Company may also refuse rental service and any contract will be void if we discover that the intended use of The Equipment will result in a serious safety hazard and/or violates any law.
Legal Right to Cancel
The Hirer has the right to cancel their order and receive a full refund of the deposit up to 6 months prior to the date of the event, after 6 months the deposit will not be refundable. Once full payment has been received (4 weeks prior to the event) a refund will not be given.
Where applicable refunds will be processed up to 14 days after The Hirer notifies The Company of their wish to cancel. Monies will be refunded via the same method used for payment.
Publicity
By agreeing to these Terms The Hirer agrees to The Company using the final video or parts thereof on Into The Edit’s website, social media channels and for promotional purposes. If there are any parts of the video The Hirer does not wish to be used for these purposes they must inform The Company in writing by email to nicola@intotheedit.co.uk. The Company will not be liable for any General Data Protection Regulation (GDPR) claims made against the final video.
The Hirer owns the raw unedited footage, The Company owns any edited footage including the final video.
These Conditions shall be in accordance with English Law and the parties herein to the jurisdiction of the English Courts.
By agreeing to these Terms and Conditions The Hirer agrees that they have read, fully understood and accept the Terms and Conditions of The Company’s services.
